Report: New witness comes forward in Dalvin Cook's case

Florida State sophomore running back Dalvin Cook is prepared to go to trial on a misdemeanor batterycharge,and has a new witness who could bolster his defense.

Cook's attorney, Ricky Patel, told TomahawkNation.com on Monday that a new witness has come forward refuting claims from another witness and details of the victim's 911 call.

Cook was charged with misdemeanor battery after allegedly hitting a woman outside a Tallahassee bar on June 23. He turned himself into Leon County Jail on July 10, and was indefinitely suspended from the football team.

Cook's legal counsel filed a demand for a speedy trial in Leon County on Thursday, "indicating (Cook) is available for trial, has diligently investigated the case, and that he will be prepared for trial by the trial date established by the Court."

Cook has a preliminary hearing set for Sept. 2, three days before FSU's season opener against Texas State in Doak Campbell Stadium.

On Sunday, during the team's media day, the Seminoles took two team pictures — one including Cook and one without him.

Cook has not been practicing with the team since it began its fall camp ahead of the 2015 season last Thursday.

Last season, Cook became the first running back in school history to rush for more than 1,000 yards as a freshman.
