TALLAHASSEE, Fla. — A Tampa entrepreneur can't grow his own marijuana to treat his lung cancer, a Florida appeals court ruled Wednesday.
Joe Redner, who owns the Mons Venus strip club, sued the Department of Health because it bars Floridians from growing medicinal cannabis. State voters made medical marijuana legal in 2016.
In April 2018, a judge ruled he could grow pot, but the state quickly appealed.
On Wednesday, the First District Court of Appeals said Redner can't grow his own pot.
In the ruling, the court said, "There is no language contained in the ballot summary that would have allowed the voters to surmise that the passing of this amendment would permit qualified patients to cultivate and process their own medical marijuana."
