Florida orchid company sues for medical marijuana license

The Tampa grower is suing the Florida Department of Health after not receiving their medical marijuana license

TAMPA, Fla. — A Tampa orchid farm is suing the Florida Department of Health, saying the state isn’t following the law and refuses to give them a license to grow medical marijuana.

Louis Del Favero Orchids has a Tampa warehouse full of nice blooms, but what they really want to grow is marijuana. The orchid company says they bought property and applied for a license.

They claim the state missed a 90-day deadline to act on their application. While they were waiting, competitors were getting licenses. 

The company claims the state of Florida violated their due process.

“We can stand in a corner and wait for the Department of Health to tell us when we can do whatever or we can hold their feet to the fire,” part-owner David Vukelga told 10 News.

The orchid company has hired a prominent civil rights attorney and is suing the State Department of Health, and several current and former employees. 

10News reached out to the Department of Health and has not heard back yet. We will update this story if we do.
