According todocuments, Baez talked with Judge Belvin Perry and other attorneys during a sidebar conversation, where lawyers talk in private with the judge.A comment was made by one of the prosecutors. "It is not our intent to beat the jury over the head with these pictures or make a big deal about them,"said Frank George.These are conversations that the jury is not privy to, however a court reporter is present.Baez reportedly told Judge Belvin Perry, "I would just lay out for our argument that any photos that would implicate or insinuate in any way that my client is a lesbian through the dancing she is doing with this other woman." Baez was unable to finish his sentence.The Judge quickly asked Baez, "Have you been to nightclubs in the last three or four years?" Baez answered yes and then pointed out the fact that the average age of jurors is over 50 and that theycould possibly be offended by the photographs.The judge made a ruling that he would, in fact, allow three pictures of Casey to beadmitted into evidence.
